Terms of Service

These terms govern your use of ClawHatch, the AI assistant platform operated at clawhatch.app. By using ClawHatch, you agree to these terms. If you do not agree, please do not use the service.

1. Service Description

ClawHatch provides a personal AI assistant running on dedicated infrastructure provisioned for each user. You interact with your assistant through messaging platforms such as Telegram and WhatsApp. We manage the underlying infrastructure — including your dedicated virtual private server (VPS), AI integrations, and message routing — so you don't have to.

Your assistant can perform tasks such as reading and sending messages, managing calendars, searching the web, controlling smart home devices, and more, depending on the integrations you enable.

2. Account & Access

• Access to ClawHatch is managed through your messaging platform account (Telegram, WhatsApp, or other supported channels).
• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of the devices and accounts you use to access ClawHatch.
• You must be at least 18 years old to use the service.

3. Acceptable Use

You agree not to use ClawHatch to:

• Violate any applicable laws or regulations
• Generate, store, or distribute illegal, harmful, or abusive content
• Attempt to access other users' assistants, VPS instances, or data
• Abuse the AI assistant's capabilities to harass, deceive, or harm others
• Overload or misuse the infrastructure (cryptocurrency mining, DDoS attacks, running unrelated services on your VPS, etc.)
• Resell or redistribute the service without our written permission
• Circumvent security measures or attempt to gain unauthorized access to our systems

We reserve the right to suspend or terminate accounts that violate these terms, with or without prior notice depending on the severity of the violation.

4. AI Assistant — Important Limitations

Your AI assistant is a tool, not a licensed professional. It may produce inaccurate, incomplete, misleading, or inappropriate responses. Specifically:

• AI-generated content should not be relied upon as legal, medical, financial, or other professional advice.
• You are solely responsible for how you use your assistant's output and any decisions or actions you take based on it.
• ClawHatch is not liable for any consequences arising from your reliance on AI-generated content.

5. Service Availability

We aim for high availability but provide the service on a best-effort basis. We do not guarantee uninterrupted or error-free operation. Maintenance, updates, infrastructure issues, and third-party service disruptions may cause temporary downtime. We will make reasonable efforts to notify you in advance of planned maintenance.

6. Payment & Billing

Pricing and billing terms are communicated when you sign up. If you cancel your subscription, your service remains active until the end of the current billing period. Refunds are handled on a case-by-case basis at our discretion.

7. Intellectual Property

• Your data: You retain ownership of all data you create, send, or store through ClawHatch, including messages, files, and configurations on your VPS.
• Our platform: ClawHatch owns all rights to the platform, software, branding, and infrastructure. These terms do not grant you any rights to our intellectual property beyond what is needed to use the service.

8. Limitation of Liability

To the maximum extent permitted by applicable law:

• ClawHatch is provided "as is" and "as available" without warranties of any kind, whether express or implied.
• We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, profits, or business opportunities.
• Our total aggregate liability for any claims arising from or related to the service is limited to the amount you have paid to ClawHatch in the 12 months preceding the event giving rise to the claim.

Nothing in these terms excludes or limits liability that cannot be excluded or limited under applicable law.

9. Termination

• By you: You may stop using ClawHatch at any time. To close your account and have your data deleted, see our Data Deletion page or email [email protected].
• By us: We may suspend or terminate your access if you violate these terms, if we are required to do so by law, or if we discontinue the service. We will provide reasonable notice where possible.

Upon termination, your dedicated VPS and all data on it will be deleted within 30 days unless you request earlier deletion or data export.

10. Modifications

We may update these terms from time to time. If changes are significant, we will notify you via your messaging channel or email at least 14 days before the changes take effect. Continued use of ClawHatch after changes take effect constitutes acceptance of the updated terms.

11. Governing Law & Disputes

These terms are governed by and construed in accordance with the laws of the Netherlands. Any disputes arising from or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.
